These terms and conditions may be amended by 78 Derngate Northampton Trust from time to time (the "Terms") apply to your use of the website and all purchases made by you through the website under the domain name www.78derngate.org.uk (the "Website"). Please read these Terms carefully before using the Website. By using the Website, you signify your agreement to be bound by these Terms.

We do our best to ensure that the information in the Website is accurate and helpful at all times. However, we cannot ultimately warrant the accuracy of that information and cannot be held liable for any use or reliance you may make of or put on it except as specifically agreed with us in any further agreement we may make with you in writing.  Further, we do our best to ensure that the Website operates properly at all times, but we make no warranties as to the availability or accessibility of the Website, and (save as otherwise set out in these Terms) we will not be liable for any damages, loss, costs or expenses incurred by you as a result of any lack of availability or accessibility of the Website.  We will not be liable for any loss, damage, expense, costs, delays or other liability whatsoever (including without limitation any financial losses such as loss of profit) which you may incur as a result of any event beyond our reasonable control (including without limitation any failure of transmission, communication, computer or other facilities or your inability to access the Website for any reason or any failure, error or delay in the sending or receiving of any notice or communication or instruction through the post or any electronic medium).  Nothing within these conditions operates so as to exclude, limit or restrict our liability for death or personal injury.  Where you deal as a consumer, nothing in the above exclusions affects your statutory rights.

3. Availability, Prices and Information

The products on the Website are offered subject to availability.  All prices are in £ sterling, including tax where applicable, and must be paid in full including the delivery charge which is an additional charge. Customers and not 78 Derngate Northampton Trust are responsible for customs duty and taxes prevailing in their own country.  78 Derngate Northampton Trust takes every care to ensure its product descriptions; price; colour and availability are accurate. However, there may be some changes which are beyond our control and variations are to be expected in handmade products. Sizes are given as a guide only.  Goods will be sent to the address given by you in your order and stated in your order confirmation. Please note that goods may occasionally be sent in instalments and we will make every effort to advise you (by e-mail) if this is the case.  By ordering a product you accept these Terms. The Terms are subject to change at any time, and it is your responsibility to check these Terms regularly before ordering products in case there are any changes.  If we cancel your order you will receive a full refund.

4. Making a purchase

In order to make a purchase you firstly need to choose and select the item you wish to buy, this is added to a shopping basket by clicking the 'Add to cart' button of the description page. As long as the contents of the order are satisfactory agree to the terms and conditions of the site and click on make an order. Once payment has been received the order is complete and you will be notified when the order has been dispatched.

5. Payment

Payments are processed through Stripe and are therefore secure. All major credit cards are accepted - click the 'Checkout' button to enter your card details. Your credit/debit card may be debited before the contract is formed. In the instance that your order is subsequently rejected by us for whatever reason, you will be provided with a refund.

6. Acknowledgement of Order

By completing and submitting the electronic order form you are making an offer to purchase goods which, if accepted by us, will result in a binding contract.  When you have completed the ordering process you will be sent an e-mail confirmation. It will state what the products are on order, the total cost including VAT (where appropriate) and Post & Package charges, together with delivery and invoice details. This email is acknowledgement of your order only and shall not constitute acceptance of your order by us. If for any reason your order cannot be processed, a member of the customer services team will try to contact you to explain the nature of the difficulty.

7. Delivery

All items are usually dispatched within 7 working days after an order has been placed. We aim to deliver within 7-10 working days. Standard UK delivery is sent by Royal Mail Signed for, these are usually received 2-3 days after dispatch. Items will require a signature on delivery. We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control.

8. Delivery charges (UK only)

‍For orders of £10 or less: £3 per order.

For orders over £10: £4.50 per order.

There is no delivery charge for vouchers which are sent via email.


International orders
Currently we are unable to take orders through our online shop from countries outside the United Kingdom. If you are interested in purchasing any items for shipping to international destinations please email: shop@78derngate.org.uk, stating which item/s you are interested in as well as the required shipping destination and your request will be dealt with on a case by case basis.

9. Guarantee

If you are not satisfied with your purchase, or it has been damaged in transit, please return it in its original packaging and with all relevant documentation within 30 days. On receipt of the returned item(s), we will issue either a refund or replacement(s) subject to availability. Please specify which you would prefer. Refunds will be issued within 30 days of the date on which we receive your returned item(s). A refund will be issued for postage paid only if the item is found to be defective or if it was incorrectly supplied from the original order. We reserve the right to charge the direct costs for the return of your item if you do not cover this expense yourself. We may offset the postage cost which we have incurred against your refund. We recommend that you use a recorded delivery service as the parcel remains your responsibility until it reaches us.  By law, customers in the EU also have the right to withdraw from the purchase of an item within seven working days of the day after the date the item is delivered (the statutory cooling off period). This applies to all our items except those specifically excluded on the Website (such as tickets or goods that have been personalised).  Goods should be returned to:

10. Amendments

We reserve the right to amend or revise these Terms at any time without notice. Any such changes to the Terms will be effective once reflected in the text of these Terms and published on this Website. 11. Governing Law

The interpretation, construction, effect and enforceability of these Terms shall be governed by English Law, and you and we agree to submit to the exclusive jurisdiction of the English courts for the determination of disputes.
